By accessing or using CutBeat (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
You acknowledge that you: - Have read and understood these Terms - Have read and understood our Privacy Policy - Have read and understood Spotify’s Terms of Service - Have a valid Spotify Premium account - Are at least 13 years old - Have the legal capacity to enter into this agreement
CutBeat is a mobile application that allows Spotify Premium subscribers to: - Create playlists - Set custom cue points (start/stop timestamps) for tracks - Control playback via the Spotify app
Important: - Music is played through the Spotify app (not in CutBeat) - You must have the Spotify app installed - Internet connection required
CutBeat requires an active Spotify Premium subscription. Music playback is controlled through the Spotify app and is subject to Spotify’s Terms of Service.
You are responsible for: - Your Spotify Premium subscription - Costs of your Spotify subscription - Complying with Spotify’s Terms of Service

CutBeat is an independent application that uses the Spotify Platform under Spotify’s Developer Terms.
THE SPOTIFY PLATFORM, SPOTIFY SERVICE, AND SPOTIFY CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
CutBeat makes no warranties or representations on behalf of Spotify.
You agree to:
You may NOT: - ❌ Use the App for illegal purposes - ❌ Attempt to decompile, reverse-engineer, or disassemble the App - ❌ Modify or create derivatives of the App - ❌ Use the App in violation of Spotify’s Terms - ❌ Share your account with others - ❌ Use automated tools (bots, scripts) with the App - ❌ Attempt to circumvent security measures - ❌ Extract source code from the App
Per Spotify Developer Policy, you may NOT use CutBeat to:
CutBeat and its original content, features, and functionality are owned by CutBeat and protected by international copyright, trademark, and other intellectual property laws.
You may: - ✅ Use the App for personal use - ✅ Create cue points and playlists
You may NOT: - ❌ Copy or modify the App - ❌ Sell or distribute the App - ❌ Use the CutBeat name or logo
All Spotify content (music, metadata, album artwork) is owned by Spotify and its licensors. You may not copy, modify, or distribute this content except through the Spotify app as permitted by Spotify.
You may NOT: - ❌ Permanently store Spotify music - ❌ Share Spotify metadata with other services - ❌ Modify album artwork or metadata - ❌ Use Spotify content for AI/ML training
You retain ownership of your cue points and playlists. By using CutBeat, you grant us a license to: - Store and display your cue points to you - Synchronize your playlists across devices (if we add this feature)
You are solely responsible for: - Your cue points and how you use them - Content in your playlists - Ensuring your use complies with these Terms
We do NOT guarantee that: - ✗ The App will be available at all times - ✗ The App will be error-free - ✗ Defects will be corrected - ✗ Servers will never have downtime
We are NOT responsible for: - ✗ Spotify service interruptions - ✗ Changes to Spotify’s API or policies - ✗ Spotify’s handling of your data - ✗ Issues with the Spotify app - ✗ If Spotify discontinues its iOS SDK
The App requires: - iOS 12 or higher - Active internet connection - Spotify app installed - Spotify Premium account
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
CutBeat is solely responsible for this App. Spotify, Apple, and their affiliates have no liability for any damages, losses, or issues arising from your use of CutBeat.
CutBeat shall NOT be liable for: - Lost data or cue points - Service interruptions - Indirect, incidental, or consequential damages - Damages exceeding the amount you paid for the App (which is $0)
MAXIMUM COMPENSATION: $0 (since the App is free)
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF: - Merchantability - Fitness for a particular purpose - Non-infringement - Error-free operation - Uninterrupted availability
You agree to indemnify and hold harmless CutBeat, Spotify, Apple, and their affiliates from all claims, damages, or expenses arising from:
Spotify AB is a third party beneficiary of these Terms and is entitled to directly enforce these Terms against you.
This means that: - Spotify can sue you if you violate these Terms - Spotify can require you to stop using the App if you violate Spotify’s policies - You cannot modify these Terms without Spotify’s approval
You may stop using the App at any time and disconnect your Spotify account by: - Clicking “Sign Out” in the App - Uninstalling the App - Requesting account deletion (privacy@cutbeat.app)
We may immediately terminate or suspend your access if you: - Violate these Terms - Violate Spotify’s Terms - Use the App for illegal purposes - No longer have Spotify Premium - Are under 13 years old
Upon termination: - Your access to the App ceases immediately - Your cue points may be deleted - These Terms remain in effect where applicable - You are still responsible for actions prior to termination
We may modify these Terms at any time. When we do, we will:
Continued use of the App after changes constitutes acceptance of the new Terms.
If you don’t agree with changes: - Stop using the App - Contact us for account deletion
These Terms are governed by the laws of Sweden, without regard to conflict of law principles.
Informal Resolution: Contact us first at support@cutbeat.app to resolve any disputes.
Court: If informal resolution fails, disputes will be resolved in Swedish courts.
Spotify Disputes: Disputes involving Spotify are subject to Spotify’s dispute resolution procedures as outlined in their Terms.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CutBeat regarding the App.
These Terms supersede all prior agreements or understandings, whether written or oral.
You may not assign or transfer your rights under these Terms to any other party.
We may freely assign our rights and obligations under these Terms.
We are not liable for failure to perform our obligations due to circumstances beyond our control, such as: - Natural disasters - War or terrorism - Internet outages - Third-party server failures (Spotify, Supabase) - Government actions

You may NOT: - Modify or create derivatives of the Spotify Platform or content - Decompile, reverse-engineer, or disassemble Spotify content - Remove or circumvent geographic restrictions - Download or “rip” music from Spotify - Manipulate play counts or followers
When using CutBeat: - Spotify logo is displayed to attribute content - Album artwork must not be modified or cropped - Metadata (song title, artist) must not be altered
We grant you a limited, non-exclusive, non-transferable, revocable license to: - Install and use the App on your own devices - Create playlists and cue points for personal use
License applies only for: - Personal, non-commercial use - Approved devices (iPhone, iPad) - According to these Terms
By creating cue points and playlists, you grant us a royalty-free, non-exclusive license to: - Store and display your cue points and playlists to you - Synchronize them across your devices (if we add this feature)
You retain all rights to your cue points and playlists.

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES. WE DO NOT WARRANT: - That the App will function error-free - That defects will be corrected - That the service will be uninterrupted - That data will always be accurate

CutBeat shall NOT be liable for: - Lost data (cue points, playlists) - Spotify service interruptions - Damage to your device - Lost profits or revenue - Indirect or consequential damages - Damages exceeding $0 (since the App is free)
Spotify and Apple: Spotify, Apple, and their affiliates have no liability for CutBeat or your use of the App.
Some jurisdictions do not allow limitation of liability for consequential damages. In these areas, the above limitations may not fully apply to you.
IMPORTANT LIMITATION:
CutBeat and Spotify are for personal, non-commercial use only.
You may NOT use the App for: - ❌ Commercial purposes (businesses, restaurants, stores) - ❌ Public performance - ❌ DJ gigs or events where you charge money - ❌ Fitness studios or dance studios open to paying customers - ❌ Broadcasting or streaming to an audience
You MAY use the App for: - ✅ Personal training at home - ✅ Dance practice for yourself - ✅ DJ preparation (practicing at home) - ✅ Private use

By using CutBeat, you consent to: - Us storing your Spotify tokens in our database - Us storing your cue points and playlists - Processing of data according to our Privacy Policy - Sharing with Spotify and Supabase (as described in Privacy Policy)
To offer a stable and functioning app, CutBeat uses Firebase Crashlytics for crash reporting. This helps us find and fix technical issues so the app works reliably. Crashlytics may involve connections to domains that Apple classifies under App Tracking Transparency (ATT). We use these solely for crash reporting and app stability, not for advertising or cross-app profiling. For details on data collected, see our Privacy Policy.
The App is NOT intended for children under 13 years old.
If you are a parent and discover your child has created an account: - Contact immediately: privacy@cutbeat.app - We will delete the account and all related data
Use of the App by children under 13 is prohibited under these Terms.
We may release updates to the App. You may need to: - Install the latest version to continue using the App - Accept new versions of these Terms - Update your iOS version
We reserve the right to: - Add, change, or remove features - Change the App’s appearance or design - Discontinue the App entirely (with reasonable notice)
You acknowledge that: - You are not located in a country subject to US or EU embargo - You are not listed on any sanctions list - You will comply with all applicable export laws
These Terms and our Privacy Policy constitute the entire agreement between you and CutBeat.
Modifications to these Terms must be made in writing and published in this policy. Oral promises or agreements are invalid.
If we do not enforce any part of these Terms, it does not mean we waive that right.
